Website Terms of Use – Medtrix Israel Ltd., Operator of Sharan Home Healthcare

1. General

The website www.sharanmedical.co.il (“the Website”) serves the customers of the Website operator. Any use of the Website is subject to the reading and acceptance by each visitor (“User” or “Client”) of the terms of use set forth below in these Terms (“the Terms”), as may be updated from time to time.

The Website is operated and managed by Medtrix Israel Ltd., Company No. 51-307003-7, located at 5 Kinneret St., BSR Tower 3, Bnei Brak (“the Website Operator”), and constitutes the official website of the Website Operator.

The Website Operator may, at its sole discretion and without prior notice, modify these Terms of Use from time to time, as well as change the structure of the Website and/or the content appearing on it, including discontinuing operation of the Website and/or any part thereof.

The Terms of Use set forth herein shall bind the User as of the time they are published on the Website and shall also apply to the User’s use of other online channels operated by the company.

The Terms of Use constitute a legally binding agreement for all intents and purposes and form the sole legal basis between the Website Operator and the User in connection with the use of the Website and/or the information contained therein. Any action performed by the User on the Website (including viewing information and content displayed on the Website) is subject to the User’s full agreement to all the Terms set forth herein.

The User hereby declares that they have carefully read these Terms of Use and agree to all provisions and conditions without exception. The User and/or anyone on their behalf shall have no claim and/or demand and/or lawsuit, directly or indirectly, against the Website Operator and/or anyone acting on its behalf in connection with these Terms of Use and/or their applicability to the User and/or the use of the Website and/or changes made to the Website and/or any malfunction that may occur on the Website. If the User does not agree to these Terms of Use and/or is dissatisfied with the information appearing on the Website, they must cease using the Website, and their right to use the Website and/or the information contained therein will terminate.

Certain sections of these Terms of Use are written in the masculine form for convenience only but are intended to apply to all genders.

The User acknowledges that the information displayed on the Website and/or any part thereof is the exclusive property of the Website Operator. The Website Operator retains all copyrights, intellectual property rights, ownership rights in the content, the Website’s code, and all designs appearing on the Website and/or any part thereof. The User may use the Website and its content solely for personal use and undertakes not to copy, photograph, reproduce, transmit, print, or publish any information appearing on the Website, nor to make any other use of the Website and/or its content or any part thereof, nor to grant any person or entity the right to perform any of the foregoing actions without the Website Operator’s prior written consent. The User is also not authorized to distort, alter, or otherwise modify the information in any way, or to take any action that may harm the accuracy, reliability, reputation, or good name of the Website Operator and/or any other party.

2. Use of Website

Any User may perform actions on the Website subject to the Terms of Use set forth herein, provided that they have an active email account, internet access, and a valid identification document.

Notwithstanding the above, the Website Operator may deny any User access to and/or use of the Website in any of the following circumstances:

(a) The User has knowingly provided false information or engaged in any fraudulent or deceptive activity through the Website.

(b) In the opinion of the Website Operator, actions have been carried out on the Website and/or in relation to the information appearing on it that are not permitted under these Terms of Use.

(c) The User has performed actions that harm or may harm the Website Operator and/or third parties.

(d) The Website Operator has decided, at its sole discretion, to discontinue operation of the Website and/or to revoke the right to use it. The User shall have no claim and/or demand against the Website Operator and/or anyone acting on its behalf in connection with the exercise of this right.

The Website Operator is entitled to block and/or remove any information appearing on the Website for any reason, including due to unlawful activity or actions that may harm the reputation of the Website and/or the Website Operator.tions.

3. User Information

User details are collected by the Website Operator through the User’s browsing activity on the Website and/or when the User enters their information on the Website. Such details may include full name, telephone number, address, email address, and identification number.

The User is under no legal obligation to provide personal information on the Website. Any User who enters their details on the Website does so voluntarily and with full consent, for the purpose of being included in the Website Operator’s databases.

The User agrees that, without derogating from any other right of the Website Operator, in cases where the Website Operator suspects that the User’s use of the Website is inconsistent with these Terms of Use and/or with any applicable law, the Website Operator shall be entitled to monitor the User’s activity on the Website, deny the User access to the Website, and/or transfer the User’s usage patterns to third parties who, to the satisfaction of the Website Operator, demonstrate that they have been harmed by the User’s infringing activity. In addition, the Website Operator may take any other action it deems appropriate in order to protect its property and/or rights, and the User shall have no claim and/or demand against the Website Operator and/or anyone acting on its behalf in connection with such actions.

4. Confidentiality and Privacy

The User declares that they are aware and agree that by entering their details on the Website, they will be included in the Website Operator’s databases. The Website Operator may use the User’s details to improve the user experience on the Website, to tailor the Website to the User’s needs and preferences, and to contact the User via regular mail, email, or any other means of communication. Entering personal details on the Website constitutes the User’s consent for the Website Operator to make any use of the User’s details and/or any information collected through the User’s browsing activity on the Website, including publication in any digital or other format, through any media channel (including television, radio, and print), transmission platforms (including internet and mobile), and on social networks such as Facebook, or any other existing or future media, all for the Website Operator’s purposes.

Providing personal details on the Website also constitutes the User’s explicit consent to receive advertising and/or marketing materials from the Website Operator and/or anyone acting on its behalf, as defined under Section 30A of the Israeli Communications Law (Telecommunications and Broadcasting), 1982. In addition, by entering their details on the Website, the User authorizes the Website Operator to use their information for direct marketing, as defined under the Israeli Privacy Protection Law, 1981. The User acknowledges their right to withdraw this consent at any time and to notify the Website Operator of their refusal to receive advertisements and/or direct marketing materials (in whole or in part), by sending notice through one of the contact methods listed in these Terms.

Without derogating from the foregoing, the Website Operator will not transfer the User’s details to third parties except in the following cases:

• If the User has committed an act or omission that harms or may harm the Website Operator and/or any third party.
• If the User has engaged in unlawful use of the Website, or in order to enable, facilitate, assist, or encourage such unlawful activity.
• If the User has violated one or more provisions of these Terms.
• If the Website Operator has received a judicial order and/or a lawful demand from a governmental authority instructing it to disclose the User’s details to a third party.
• In the event of any dispute, claim, demand, or legal proceeding between the parties.
• For the purpose of direct marketing as defined under the Israeli Privacy Protection Law, 1981.
• Where disclosure is required in order to provide and/or improve a specific service, in accordance with the terms of that service (for example, the User’s Kupat Holim).

Use of the Website constitutes the User’s consent to receive communications from the Website Operator and/or anyone acting on its behalf via fax, telephone, email, automated dialing systems, and/or any other means of communication, for any of the purposes described in these Terms.

Use of Cookies: The Website Operator uses cookies as part of the Website to enhance the user experience, collect statistical data regarding User activity on the Website, secure information on the Website, and for one or more of the uses described in these Terms. Cookies are files that enable tracking of User activity on the Website, some of which may remain stored on the User’s device even after leaving the Website. Use of the Website constitutes the User’s consent to the installation of such cookies on the device used to access the Website. Notwithstanding the above, the User may configure their browser settings to refuse cookies; however, doing so may impair certain aspects of the Website’s functionality. The Website server may automatically store information generated by the User, including, among other things, the User’s IP address, browser type, referring website, and similar data.

5. Data Collected on the Website by Third Parties

The Sharan Home Healthcare website (www.sharanmedical.co.il) includes tracking pixels (components) from Google and Facebook. In accordance with the terms of use of these platforms, these components enable them to collect information about the pages you visit on the Website. For the avoidance of doubt, your medical information, if you are a client of the company, is stored exclusively within Sharan Home Healthcare’s internal systems. Google and Facebook do not have access to this medical information.

6. Risks and Liability

The User acknowledges that the use of websites involves various risks, both due to the technology involved and due to human factors operating through the internet. The Website Operator and/or anyone acting on its behalf shall not be responsible for any unlawful activity carried out, if any, by any User of the Website and/or by any third party not acting on its behalf. The User bears sole and full responsibility for any use they make and/or will make of the Website and/or the information appearing therein.

The information on the Website is intended to enrich the User’s knowledge and for personal use only. Any use of the information, including any reliance upon it, is at the User’s sole responsibility. The User acknowledges, among other things, that the images displayed on the Website are for illustrative purposes only and that differences may exist between their appearance on a computer screen and their actual appearance.

The Website Operator makes significant efforts to ensure that the information on the Website is as accurate and up to date as possible; however, the information does not purport to constitute a complete, comprehensive, or detailed analysis of all subjects presented. The User acknowledges that the information is provided on an “As Is” basis and that errors may exist. The Website Operator shall not be liable for any inaccuracies in the information presented and/or for its suitability to the User’s needs, nor shall it be liable for the User’s inability to use the information for any reason and/or for any inaccuracy or error therein.

The information on the Website does not constitute medical advice and/or a medical opinion and is not a substitute for professional medical consultation. For any medical question, the User must consult a physician directly. The Website Operator shall not be liable for any damage, inconvenience, loss, expense, distress, and/or bodily injury that may be caused to the User, their property, or any third party, directly or indirectly, as a result of the use of the Website content and/or reliance upon the information provided. The User hereby waives any claim against the Website Operator and/or anyone acting on its behalf in connection with the use of the information on the Website and bears sole responsibility for any such use.

The Website Operator shall not be liable for any unlawful activity carried out by any User of the Website or by any third party beyond its control.

Information security on the Website is implemented to protect the User’s privacy and the information displayed. The User acknowledges that the Website Operator takes customary and reasonable measures to maintain confidentiality and privacy, prevent unauthorized use, and safeguard the information in accordance with applicable law. However, the User understands that malfunctions beyond the Website Operator’s control may occur. The Website Operator and/or anyone acting on its behalf shall not be liable for any damage of any kind, direct or indirect, caused to the User and/or anyone on their behalf as a result of use of the Website and/or if the User’s information is compromised due to such use and/or if access to the Website is disrupted or unavailable, including loss of income and/or loss of profits for any reason.

The Website Operator’s records regarding actions performed on the Website by the User shall constitute conclusive evidence of their correctness. For the avoidance of doubt, the Website Operator shall not be bound by any statements, explanations, representations, or interpretations made by anyone on its behalf, whether included in the press, marketing materials, or any other advertising or illustrative media, except as expressly set forth in these Terms.

The Website Operator shall not be responsible for the content or nature of information presented on the Website where such information originates from third parties. The User shall have no claim and/or demand against the Website Operator and/or anyone acting on its behalf in this regard.

The User agrees to indemnify and/or compensate the Website Operator, upon its first demand, for any direct and/or indirect damage and/or expense incurred in connection with any claim, demand, or allegation by the User and/or anyone on their behalf arising from the User’s use of the Website and/or breach of these Terms of Use.

The Website may contain links to other websites, provided solely for the User’s convenience. The Website Operator is not responsible for such links and/or the linked websites and/or the information appearing therein. Any access to or use of such links is at the User’s sole responsibility. The Website Operator and/or anyone acting on its behalf shall not be liable for any damage, direct or indirect, financial or otherwise, caused or potentially caused to the User as a result of such use.

The Website Operator and/or anyone acting on its behalf shall not be liable for the server through which the Website operates, including that such server may be free of viruses and/or other components that may harm the User’s computer during use of the Website. The User shall have no claim and/or demand against the Website Operator and/or anyone acting on its behalf in this regard.

7. Lab Tests at Home – Eligibility Terms for Clalit Mushlam and Platinum Members

The service is available to members of Clalit Health Services (Kupat Holim Clalit) aged 5 and older.

To qualify for the reduced co-payment rate of ₪35 (including VAT), the patient must have an active Clalit Mushlam and/or Platinum membership.

Clalit members who are not enrolled in Mushlam and/or Platinum are eligible for the service at a cost of ₪150 (including VAT).

A valid referral for blood and/or urine tests must be available in Clalit’s systems at the time of booking.

A digital appointment request (via the scheduling system) is considered confirmed only after receiving confirmation from the company.

The patient must present a valid ID to the nurse at the time of the home visit.

Tests are performed between 6:00 a.m. and 10:00 a.m., at the patient’s home or at another address provided by the patient.

The Lab Tests at Home call center can be reached at 1-700-500-616 (press 1). The call center operates Sunday through Thursday from 7:00 a.m. to 7:00 p.m., and Friday from 8:00 a.m. to 12:00 p.m.

In order to receive the service, the patient must consent to the storage of their personal information in the Website Operator’s database. Without such consent, the service cannot be provided.

To cancel or reschedule your appointment, please call 1-700-500-616 or email [email protected]. Please include your Kupat Holim in the body of the email.

The information will be stored for the purpose of providing and improving the service and may be shared with Clalit Health Services for service improvement purposes.

The service is subject to the availability of medical staff in the patient’s area of residence.

8. Lab Tests at Home – Eligibility Terms for Meuhedet Members

The service is available to members of Meuhedet Health Fund (Kupat Holim Meuhedet) aged 5 and older.

Members enrolled in Meuhedet Adif or Meuhedet Si are eligible for the service at a co-payment of ₪25 (including VAT).

Meuhedet members who are not enrolled in Adif or Si are eligible for the service at a cost of ₪150 (including VAT).

A valid referral for blood and/or urine tests must be available in Meuhedet’s systems and must be sent to the call center prior to the appointment.

The patient must present a valid ID to the nurse at the time of the home visit.

Tests are performed between 6:00 a.m. and 10:00 a.m., at the patient’s home or at another address provided by the patient.

The Lab Tests at Home call center can be reached at 1-700-500-616 (press 3). The call center operates Sunday through Thursday from 7:00 a.m. to 7:00 p.m., and Friday from 8:00 a.m. to 12:00 p.m.

Cancellation Policy:

Appointments may be canceled by calling 1-700-500-616 (press 3) or by sending an email to [email protected].

• An appointment scheduled for Monday through Thursday may be canceled no later than 5:00 p.m. on the preceding day.
• An appointment scheduled for Sunday may be canceled no later than 12:00 p.m. on the preceding Friday.
• An appointment scheduled for the day following a holiday may be canceled no later than 12:00 p.m. on the eve of the holiday.

If an appointment is not canceled within the required time frame, no refund will be issued.

If a test is not performed due to an act or omission by the patient (such as insufficient fasting time, refusal to undergo testing, failure to respond, etc.), the full fee will be charged. In the unfortunate event of the patient’s passing prior to sample collection, no charge will apply.

In the event of hospitalization before the sample is collected, the patient will be entitled to a repeat visit at no additional charge.

In order to receive medical services, the patient must consent to the storage of their personal information in the Website Operator’s database. Without such consent, the requested service cannot be provided.

The information will be stored for the purpose of providing and improving the service and may be shared with Meuhedet Health Fund for service improvement purposes.

The service is subject to the availability of medical staff in the patient’s area of residence.

9. At-Home Lab Services – Eligibility and Terms for Maccabi Members

• The service is available to Maccabi Kupat Holim members aged 5 and above.
• To be eligible for the subsidized fee of ₪50 (including VAT), the patient must have Maccabi supplementary insurance. The service is available in select locations.
• Maccabi members without supplementary insurance are eligible for the service at a cost of ₪150 (including VAT).
• To schedule a blood and/or urine test at home, the patient must send a referral from Maccabi to [email protected]. After receiving the referral, a Sharan representative will contact the patient to schedule an appointment. Appointments can also be scheduled via the personal area on the Maccabi website.

Cancellation Policy
Appointments can be canceled by calling 1-700-500-616 (extension 2) or by emailing [email protected].
No refund will be issued for appointments not canceled within the required timeframes.

• Appointments scheduled for Monday through Thursday – must be canceled by 5:00 PM on the previous day
• Appointments scheduled for Sunday – must be canceled by 5:00 PM on the preceding Thursday
• Appointments scheduled for the day following a holiday – must be canceled by 5:00 PM on the day before the holiday eve

• If a test is not performed due to the patient’s action or inaction (e.g., insufficient fasting time, refusal to be tested, unavailability), the full fee will be charged. In the event of the patient’s passing prior to the test, no charge will apply.
• If the patient is hospitalized before the sample is collected, they will be entitled to a repeat home visit at no additional cost.
• The patient must present a valid ID to the nurse at the time of the home visit.
• Tests are conducted between 6:00 AM and 10:00 AM at the patient’s home or another address provided by the patient.
• The At-Home Lab service center can be reached at 1-700-500-616 (extension 2), Sunday–Thursday, 8:00 AM–5:00 PM.
• To receive medical services, the patient must consent to having their information stored in the service provider’s database. Without this consent, the service cannot be provided.
• The information will be used for service delivery and improvement and may be shared with Maccabi Kupat Holim for these purposes.
• The service is subject to the availability of medical staff in the patient’s area of residence.

10. Cancellation Policy Under the Consumer Protection Law

In accordance with the Israeli Consumer Protection Law, in a remote sales transaction, the patient may cancel the transaction within fourteen (14) days from the date the transaction was made, provided that such cancellation is made at least two days, excluding rest days, prior to the scheduled date of service.

In the event of such cancellation, the patient will be refunded the amount paid for the canceled service, less a cancellation fee of 5% of the transaction amount or ₪100, whichever is lower.

11. Additional Provisions

These Terms of Use shall be governed by the laws of the State of Israel. Exclusive jurisdiction in any matter arising hereunder shall be vested in the competent courts of the Tel Aviv District, and no other court shall have jurisdiction.

In order to request removal from the company’s databases, to notify the company of refusal to receive marketing materials, and/or to request access to personal information held in the company’s databases, the User may contact the company in writing through one of the following methods:

The Website Operator may assign and/or transfer its rights and obligations under these Terms, in whole or in part, to any third party, without the User’s consent and without prior notice. The User may not assign and/or transfer their rights and/or obligations under these Terms, in whole or in part, to any third party without the Website Operator’s prior written consent.

Section headings are provided for convenience only and shall not be used for the purpose of interpreting these Terms.
